I invite your attention the reference second cited, wherein the Joint Secretary (Institutions & Training), Govemment of India, Ministry of Education, Department of School Education & Literacy Shastri Bhavan, New Delhi has stated as follows

This Department has received a large number of representations from individual teachers, teachers associations, Members of Parliament, etc., seeking relief from the implications of the aforesaid judgment. In these representations, it has been highlighted that requiring teachers who are in the twilight of their careers to qualify TET may be difficult and emotionally distressing. It has also been contended that the judgment may adversely affect the financial security earned by such teachers over decades of service. Further, the potential exit of experienced teachers may create a significant vacuum in the State's education system. 3. In order to enable this Department to examine the matter in its correct perspective, it is imperative to ascertain the exact number of teachers likely to be affected by the said judgment.
2. The Joint Secretary (Institutions & Training), Government of India, Ministry of Education, Department of School Education & Literacy Shastri Bhavan, New Delhi has requested as follows:-
(i) To instruct the concerned officers in our State to compile the requisite data in the enclosed format.
(ii) Before furnishing the data, it may please be vetted diligently to verify its correctness and accuracy.
(iii) Comments on the implications of the judgment with respect to our State and possible pathways to provide relief to the affected teachers may also be furnished. While providing the comments, appropriate legal opinion may please be solicited from the competent authority in our State. (iv) Please ensure that the requested information and comments may be furnished by 16th January, 2026.
(v) In D.O. letter No. 7-2/2025-15.20 dated 24.03.2025, it was requested to update the Recruitment Rules (RRs) in our State so as to bring them in conformity with the minimum standards prescribed by the National Council for Teacher Education (NCTE). In light of the judgment of the Hon'ble Supreme Court. it could be ensured in a time-bound manner
3. I am therefore to request you to furnish the details of the exact number of teachers likely to be affected by the above said judgment of Supreme Court of India (dated 01.09.2025) and to compile the requisite data in the prescribed format along with the comments on the implications of the judgment with respect to our State and possible pathways to provide relief to the affected teachers to Government on or before 08.01.2026. 4. This may be treated as Most Immediate. I am happy to share with you the recently updated and issued Recruitment Rules
of KVS (uploaded posts non-academic and academic for https://kusangathan.nic.in/en/recruitment-rules/). These RRS have been framed to ensure that they are in conformity with minimum qualification for a person to be eligible for appointment as a teacher, framed by NCTE, including qualifying the TET examination. The NCTE Regulations in this regard are uploaded on their website.
2. You are aware that NEP 2020 has placed teachers at the centre of any fundamental reforms in the education system. Competent and committed teachers are critical to improving the quality of learning and assessment. Recruitment methods and processes largely determine the selection of quality teachers. We need to ensure recruitment of quality teachers to enable best possible future for our children.
3. I would therefore request you to kindly examine the RRS of teachers in your State/UT in the light of attached RRS of KVS and ensure that RRS of your State/UT are updated appropriately.
I would deeply appreciate if you could keep me periodically appraised about the action taken in this regard and would be happy to address any issues you may have.
