ORDER:
In the Government Order first read above, Government have approved the notification for recruitment to the post of Health Inspector Grade-II in Tamil Nadu Public Health Subordinate Service for publication.
2. In her letter third read above, the Chairman, Medical Services Recruitment Board, Chennai, has stated among others that the Member Secretary, Sports Development Authority of Tamil Nadu, Chennai has been addressed by her with a request to sponsor eligible candidates for 43 vacancies out of 1472 vacancies in the post of Health Inspector Grade-II in Tamil Nadu Public Health Subordinate Service under 3% reservation in selection for appointment of meritorious sports persons for the said post to the appointing authority namely the Director of Public Health and Preventive Medicine, Chennai for issue of appointment / posting orders vide Medical Services Recruitment Board office letter dated 11.08.2025. She has also stated that the distribution of vacancies for 1429 (1472-43) [i.e., 1376 Regular + 53 shortfall vacancies (SC - 43 and ST 10)] vacancies has been prepared duly following communal rotation and including shortfall vacancies for the said post as annexed to this order and requested to approve the distribution of vacancies and give necessary orders to include the same in the notification which is already approved by the Government for the post of Health Inspector Grade II as ordered in G.O.(D) No.361, Health and Family Welfare (L1) Department, Dated 08.04.2025. 3. The Chairman, Medical Services Recruitment Board, Chennai has also stated that the Hon'ble High Court of Madras in its order dated 15.04.2025 in W.A.No.987 of 2023 filed by Thiru.P.Vadivel and 30 others has ordered as follows:
23......this Writ Appeal is disposed of with the following directions a) The respondent Health and Family Welfare Department is hereby directed to take early decision and give direction to the Medical Recruitment Board for issuance of notification to go ahead with the recruitment process for conducting recruitment for 334 posts or any other higher number to be fixed by the Government depending upon the vacancy position as of now, for filling up the post of Multipurpose Health Worker (Male) / Health Inspector Grade-II, by conducting a competitive examination for all the applicants, who are eligible to make applications as per the notification prescribed by giving relaxation to Rule 5(2) under G.O.Ms.No.338, Health and Family Welfare Department, dated 02.08.2019.
b) Such a decision as indicated in Clause (a) above shall be taken within a period of four weeks from the date of receipt of a copy of this order and be communicated to the Medical Recruitment Board.
c) On receipt of such Government Order to be issued in this regard by the State Health and Family Welfare Department, the Medical Recruitment Board shall proceed to issue notification in accordance with the above observations as well as the Government Order to be issued in this regard, within a period of 30 (thirty) days thereafter.
d) Once such a notification is issued, it is open to all the eligible applicants including the present appellants / writ petitioners to participate in the selection process including the written competitive examination.
e) In the meanwhile, it is open to the appellants/writ petitioners to make a special request to the Government for giving age relaxation. If such a plea is made by the appellants / writ petitioners or any other similarly placed persons, the same shall be decided immediately well before the last date of receipt of applications made by the Medical Recruitment Board as directed above.
f) Insofar as the qualification with regard to the Certificate Course/ Diploma Course is concerned, G.O.Ms.No.45 Higher Education Department dated 19.04.2022 can be taken into account.

The Chairman, Medical Services Recruitment Board, Chennai has further stated that the Government have amended the adhoc rules for the post of Health Inspector Grade-II in G.O.(Ms) No.104, Health and Family Welfare (L1) Department Dated: 28.03.2023. As per the amendment made in the above said Government Order the qualification for the post of Health Inspector Grade-II has been prescribed as follows: Must have passed plus two with Biology or Botany and Zoology. Must have passed Tamil Language as a subject in S.S.L.C. Level. Must possess Two years Multipurpose Health Worker (Male) / Health Inspector/Sanitary Inspector Course Certificate granted by the Director of Public Health and Preventive Medicine.
Provided that those who possess one year Multipurpose Health Worker (Male) training course certificate granted by the Director of Public Health and Preventive Medicine conducted in the Government training centre or Institutions approved by the Director of Public Health and Preventive Medicine, prior to the introduction of the two years Multipurpose Health Worker (Male) / Health Inspector / Sanitary Inspector Course certificate granted by the Director of Public Health and Preventive Medicine are also eligible for appointment to the said post.

The Chairman, Medical Services Recruitment Board, Chennai has also stated that the above said amended rule provision has been incorporated in the notification as approved by the Government in G.O.(D) No.361, Health and Family Welfare (L1) Department, Dated 08.04.2025. The educational qualification for the post of Health Inspector Grade II is as per the amendment issued vide the G.O.(MS).No.104, Health and Family Welfare (L1) Department Dated: 28.03.2023, whereas the Hon'ble High Court of Madras in its orders dated 15.04.2025 in W.A.No.987 of 2023 filed by Thiru.P.Vadivel & 30 others, has given direction to the Medical Services Recruitment Board for issuance of notification with regard to the recruitment process for filling up the Health Inspector Grade-II, by conducting a competitive examination for all the applicants, who are eligible to make applications as per the notification prescribed by giving relaxation to Rule 5(b) under G.O.Ms.No.338, Health and Family Welfare Department, dated 02.08.2019. Further, it is stated that in paragraph No.23 (e) of the Judgment Dated: 15.04.2025 in W.A.No.987 of 2023, the Hon'ble High Court has directed that it is open to the appellants / Writ petitioners to make a special request to the Government for giving age relaxation. If such a plea is made by the appellants / writ petitioners or any other similarly placed persons, the same shall be decided immediately well before the last date for receipt of application made by the Medical Services Recruitment Board.

The Chairman, Medical Services Recruitment Board, Chennai has, therefore, requested the Government to issue necessary orders / instructions with regard to the orders of the Hon'ble High Court of Madras passed in W.A.No.987 of 2023 filed by Thiru.P.Vadivel and 30 others, so as to enable the Medical Services Recruitment Board to publish the Notification for the recruitment to the post of Health Inspector Grade-II as directed by the Hon'ble High Court of Madras and to issue necessary approval for including the distribution of vacancies in the notification. She has also requested to entrust the confidential work of preparation of question bank to an authority and depute Government's representation to monitor the confidential work and upload the Question Paper for Computer Based Test..
7. In his letter fifth read above, the Director of Public Health and Preventive Medicine, Chennai has stated that the Government have issued necessary orders declaring the course offered by the WASH Institute and Pondicherry University as equivalent to the Sanitary Inspector Course / Multipurpose Health worker (one year) Course conducted by Directorate of Public Health and Preventive Medicine/ Government of Tamil Nadu in G.O.(Ms). No.45, Higher Education (K1) Department, dated. 19.04.2022 and G.O. (Ms) No.243, Higher Education (K1) Department, dated. 12.09.2023 respectively. Further, in G.O.(Ms) No.91, Human Resource Management Department, dated. 13.09.2021, it has been ordered that the maximum age for OC Candidate to participate in recruitment process is 32 Years.
8. In order to comply with the orders of the Hon'ble High Court of Madras passed in W.A.No.987 of 2023, the Director of Public Health and Preventive Medicine, Chennai has requested the Government to relax rule 5(b) of the Adhoc Rules governing the post of Health Inspector Grade-II in Tamil Nadu Public Health Subordinate Service to all eligible applicants who have passed one year course certificate [University / Institute received equivalent certificate] to participate in the recruitment process as one time measure as done in G.O (Ms) No.338, Health and Family Welfare (LI) Department, dated 02.08.2019 and age relaxation in respect of the all applied eligible OC candidates as there is no age restrictions for the candidates belonging to SC/ST/SCA, BC/BCM/MBC & DNC.
9. The Director of Public Health and Preventive Medicine, Chennai has also requested the Government to accord necessary permission to Medical Services Recruitment Board to carry out the above said relaxation in the notification for filling up of the Post of Health Inspector Grade II in Tami Nadu Public Health Subordinate Service.
10. The Government have examined the proposal of the Chairman, Medical Services Recruitment Board and the Director of Public Health and Preventive Medicine, Chennai and in the light of the orders passed by the Hon'ble High Court of Madras dated 15.4.2025 decided to comply with the orders of the Hon'ble Court. The Government accordingly, do and hereby direct that the rule 5(b) of the Adhoc Rules governing the post of Health Inspector Grade-II to all eligible applicants who have passed one year course certificate from those University / Institute which received equivalent certificate so as to participate in the recruitment process as one time measure as done in vide G.O.(Ms) No.338, Health and Family Welfare (LI) Department, dated 02.08.2019 and rule 5(a) of the above said Adhoc Rules (relating to age) in respect of all applied eligible OC candidates as a one-time measure (i.e. no age restrictions), be relaxed in exercise of powers conferred under Section 58 of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016. Necessary permission to the Medical Services Recruitment Board is hereby accorded to include the above said relaxation in the Notification for filling up of the post of Health Inspector Grade II.
11. The Government hereby also approve the distribution of vacancies furnished by the Chairman, Medical Services Recruitment Board as annexed to this order.
12. The Government hereby also order that the Director of Public Health and Preventive Medicine be entrusted with the Confidential work of Preparation of Question Bank for written examination for recruitment to the post of Health Inspector Grade II by forming a Committee at his level and depute Thiru.P.Jawaharlal Nehru,
