முன்னுரிமை மட்டும் கணக்கில் கொள்ளாமல் தகுதியின் (Merit) அடிப்படையில் பதவி உயர்வுகளை நிர்ணயம் செய்வதற்கு வேண்டிய வழிமுறைகளை மேற்கொள்ள அனைத்து துறை செயலாளர்களுக்கும் தலைமைச் செயலாளர் அறிவுறுத்தல்

உச்ச நீதிமன்ற வழிகாட்டுதலின்படி 10-03-2003 க்கு பிறகு நியமனம் செய்யப்பட்டவர்களில், முன்னுரிமை மட்டும் கணக்கில் கொள்ளாமல் தகுதியின் (Merit) அடிப்படையில் பதவி உயர்வுகளை நிர்ணயம் செய்வதற்கு வேண்டிய வழிமுறைகளை மேற்கொள்ள அனைத்து துறை செயலாளர்களுக்கும் தலைமைச் செயலாளர் அறிவுறுத்தல் - Chief Secretary instructs all departmental secretaries to take steps to determine promotions based on merit rather than priority

Sub: Fixation of seniority based on merit- Action taken on the Orders of Supreme Court of India - Requested - Regarding. Ref: Supreme Court of India order, dated 18.04.2023 in C.P.(C) Diary No.6415 of 2021 and other batch cases.

I am directed to inform that with regard to fixation of seniority, the Supreme Court of India in its order, dated 18.04.2023 in C.P.(C) Diary No.6415 of 2021 and other batch cases, has directed the following:-

(i) to complete the exercise of finalizing the seniority lists of selection processes conducted after 10th March, 2003 on the basis of the principle that the seniority list shall be reckoned only on the basis of the merit as determined by the Tamil Nadu Public Service Commission in the selection process;

(ii) if any list is finalized in case of selection held prior to 2003 giving benefit to the persons selected as per their seniority or as per merit, the same shall also not to be disturbed;

(iii) if this exercise is not completed within a period of three months from today (18.04.2023), we will consider re-opening of the contempt proceedings.

2. I am therefore to request you to send the action taken on the above said orders of the Hon'ble Supreme Court of India to this department, immediately, so as to file compliance report before the Supreme Court of India, in this matter. Yours faithfully.
