தமிழகத்தில் தனியார் பள்ளிகளில் அரசியல், மதம் சார்ந்த நிகழ்ச்சி நடத்த தடை

தனியார் பள்ளிகளில் அரசியல் மற்றும் மதம் சார்ந்த நிகழ்வுகள், பிரிவினையைத் தூண்டும் நிகழ்வுகளை நடத்த பள்ளிக்கல்வித் துறை தடை விதித்துள்ளது.

தமிழக பள்ளிக்கல்வித் துறையின்கீழ் 12 ஆயிரத்துக்கும் மேற்பட்ட தனியார் பள்ளிகள் இயங்கி வருகின்றன. தனியார் பள்ளிகளில் சாதி, மதம் சார்ந்த நிகழ்வுகள் நடத்தப்படுவதால் பல்வேறு பிரச்சினைகள் ஏற்படுகின்றன.

இதை தவிர்ப்பதற்காக தனியார் பள்ளிகள் சட்ட விதிகளில் சில திருத்தங்கள் செய்து அரசிதழில் தற்போது வெளியிடப்பட்டுள்ளது. அதன்படி தனியார் பள்ளிகளில் அரசியல், மதம் சார்ந்த நிகழ்வுகள் மற்றும் பிரிவினையைத் தூண்டும் நிகழ்வுகளை நடத்த தடை விதிக்கப்பட்டுள்ளது.

இதுகுறித்து பள்ளி கல்வித்துறை செயலர் பி.சந்திரமோகன் வெளியிட்டுள்ள உத்தரவில், ‘‘தமிழ்நாடு தனியார் பள்ளிகள் சட்ட விதிகளில் திருத்தங்கள் செய்யப்பட்டுள்ளன. அதன்படி, தனியார் பள்ளிகள் அங்கீகாரம் பெறுவதற்குரிய கட்டணம் உயர்த்தப்பட்டுள்ளது.

அதே போல், பள்ளி வளாகத்தை அரசியல், கருத்தியல், வகுப்புவாத, பிரிவினைவாத மற்றும் கல்வி நோக்கமற்ற நிகழ்ச்சி, கூட்டம், பிரச்சாரம் ஆகியவற்றை நடத்த பயன்படுத்தக் கூடாது.

கலாச்சார நிகழ்வுகள், சமூக சேவை திட்டங்கள், ரத்ததான முகாம்கள், நினைவு விழாக்கள் போன்ற செயல்பாடுகள், அவை மதம், அரசியல் சாராமல், பள்ளியின் நேரடி மேற்பார்வையில் நடத்தப்பட்டால் மட்டுமே அனுமதிக்கப்படும்.

மேலும், இதுசார்ந்து அரசால் குறிப்பிடப்படும் தகுதிவாய்ந்த அதிகாரியிடம் முன் அனுமதி பெற வேண்டும். இவ்வாறு அதில் கூறப் பட்டுள்ளது.

ஆர்எஸ்எஸ் மற்றும் சிறுபான்மையின அமைப்புகள் பள்ளி வளாகங்களில் தொடர்ந்து மதம் சார்ந்த நிகழ்ச்சிகளை நடத்துவதாக கல்வித்துறைக்கு புகார்கள் வந்தன. அதைத்தொடர்ந்து தமிழக அரசு இந்த நடவடிக்கையை எடுத்துள்ளது

NOTIFICATIONS BY GOVERNMENT

SCHOOL EDUCATION DEPARTMENT

AMENDMENTS TO THE TAMIL NADU PRIVATE SCHOOLS (REGULATION) RULES, 2023 [G.O.Ms.No.51, School Education (MS), 2nd March 2026, மாசி 18, விசுவாவசு, திருவள்ளுவர் ஆண்டு-2057) No. SRO A-6(b)/2026.

In exercise of the powers conferred by section 57 of the Tamil Nadu Private Schools (Regulation) Act, 2018 (Tamil Nadu Act 35 of 2019), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Private Schools (Regulation) Rules, 2023, namely:- AMENDMENTS

In the said Rules,

(1) in rule 8,

(a) to sub-rule (5), the following proviso shall be added, namely:-

"Provided that the fee to be paid for every application for grant of certificate of recognition for more than three years shall be Rs.25,000/- (Rupees twenty five thousand only) for Nursery and Primary Schools and Rs.50,000/- (Rupees fifty thousand only) for Middle, High and Higher Secondary Schools or as may be specified by the Government from time to time".

(b) in sub-rule (8), for the expression "or the building license whichever is earlier", the expression "or for the period of twenty years whichever is earlier" shall be substituted:

(2) after rule 8, the following rule shall be inserted, namely:-

"8-A. Notwithstanding anything contained in these rules, the Primary and Nursery Schools which were in existence on the date of publication of these rules in the Tamil Nadu Government Gazette and intend

to upgrade shall apply for permission to upgrade in Form I-B and for grant of certificate of recognition in Form II-A subject to the fulfillment of requirements specified in Annexure-III".

(3) in rule 35, after sub-rule (2), the following sub-rules shall be added, namely:- Ex-III-1(a)-(140) TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY

"(3) The land, buildings and facilities of every recognised private school shall be utilised primarily and exclusively for academic instruction, co-curricular activities, extra-curricular activities, student welfare programmes and school functions conducted under the authority and supervision of the educational agency.

(4) (a) No school premises shall be used, whether during or outside school hours, for organising, conducting, or facilitating any programme, meeting, campaign, instruction, or any activity by any external person, association, or organisation which is in the nature of:- (i) political or ideological;

(ii) communal or divisive; or

(iii) otherwise, unrelated to the educational objectives of the school.

(b) Cultural events, social service programmes, blood donation camps, commemorative functions, or similar activities shall be permitted only if they are non-sectarian, non-political, and conducted under the direct supervision and responsibility of the educational agency, and subject to such prior permission of the competent authority or any other authority as may be specified by the Government.

Explanation -

For the purposes of this sub-rule, "communal or divisive activity" means any activity which is intended or likely to promote disharmony, enimity, hatred, or ill-will among students on the basis of religion, race, caste, community, language, or ideology, or which undermines the objectives and inclusive character of the private school".

(4) in Form III-A, in para 2, after clause (vi), the following clauses shall be added, namely:-

"(vii) the educational agency shall upload a self-declaration for compliance of the provisions of the Act and Rules to the competent authority on or before the 30th April of every year in the portal as may be specified by the Government".
