நீதிமன்ற அவமதிப்பு வழக்கு தொடுத்த ஆசிரியருக்கு, ஊதியம் வழங்கும் வரை இராமநாதபுரம் மாவட்ட முதன்மைக் கல்விஅலுவலருக்கு ஊதியத்தை நிறுத்த சென்னை உயர் நீதிமன்ற மதுரைக் கிளை உத்தரவு!

This Court by an order dated 20.12.2023 had directed the respondents 4 and 5 (School Management) to forward the salary bills of the writ petitioner to the respondents 2 and 3. On receipt of the said proposal, respondents 2 and 3 were directed to pass orders disbursing the salary within a period of two weeks from 01.11.2022 onwards. 2.Alleging violation of the order of this Court, the contempt petition was filed in January 2024. Statutory notice was issued to the respondents 3 and 4 and after their personal appearance, their further appearance were dispensed with on an undertaking that they would take steps to disburse the salary.

On 10.07.2024, the School Management had given an undertaking to forward the proposal for disbursement of salary. However, it is the contention of the contempt petitioner that from July 2024, the salary has not been disbursed and the first respondent in the contempt petition has not taken any steps to release the salary.

3.Though the first respondent in the contempt petition has received the salary bills, so far no effective steps have been taken. One reason or the other is being cited by the said respondent. Therefore, it is clear that the Chief Education Officer, Ramanathapuram District is continuing to willfully disobey the orders of this Court despite leniency shown by this Court.

4.In view of the above said facts, this Court is constrained to issue a direction to the Director of School Education not to release the salary of Chief Education Officer, Ramanathapuram until he/she clears the salary bill of the writ petitioner. 5.Registry is directed to mark a copy to the Director of School Education, Chennai and the District Treasury Officer, Ramanathapuram.
