Sub: Timely Compliance with Court Orders and Legal Procedures

Kindly recall the discussions held in the All Secretaries Meeting on 30.08.2023 about the timely action on the Court orders. In this regard, I would like to once again stress on the timely and responsible handling of legal matters involving the Government, particularly those brought before the Hon'ble High Court of Madras and its Madurai Bench.

2. A large number of cases and writ petitions are filed against the Government in various courts. In many instances, these cases have resulted in orders passed by the Hon'ble Court in favour of the petitioners, often accompanied by specific time limits for compliance. It is imperative that we, as representatives of the Government, demonstrate our unwavering commitment to the rule of law and the judicial process.

3. To ensure that our response to these legal matters is both efficient and in line with established legal procedures, I wish to underscore the following key directives:

Timely action on court orders: Immediate action shall be taken on the orders issued by the Hon'ble High Court. The stipulated timelines for compliance are not to be taken lightly, and we must prioritize prompt execution of the court's directions. Legal opinion and course of action: Upon receiving a copy of the Court Order, it is mandatory to seek legal opinion from the appropriate

Law Officer of the Government regarding the further course of action. If the decision is not to file an appeal, swift steps must be taken to implement the order within the specified time frame.

Filing of appeals: In cases where it is determined that an appeal is the appropriate course of action, the appeal must be filed in the relevant court, and every effort should be made to obtain a stay, if deemed necessary.

Monitoring and reporting: Action Taken Reports on judgments delivered by the Hon'ble High Court and the Supreme Court of India must be personally monitored periodically by the Secretaries to the Government and Heads of Departments. Each department shall ensure strict compliance with court orders to prevent any breach or contempt of the court's directives. It is incumbent upon all staff members to adhere to these instructions diligently.

4. In summary, I emphasize the need for meticulous care within our departments to ensure the full compliance of court orders. We must be proactive in our approach, working collaboratively to uphold the principles of justice and accountability. There should be no room for any lapses or oversights in this regard.

5.
