Sub School Education Timely Compliance with Court Orders and Legal Procedurs - Intimation - Regarding.


Sir/Madam,

I have repeatedly drawn your attention during all legal cases review meetings am to reiterate that a large number of cases and writ petitions are filed against School Education Department in various courts.

In many instances, these cases have resulted in orders passed by the Hon'ble Court in favour of the petitioners, often accompanied by specific time limits for compliance.

It is imperative that we, as representatives of the Government, demonstrate our unwavering commitment to the rule of law and the judicial process.

To ensure that our response to these legal matters is both efficient and in line with established legal procedures and in keeping with the directions issued by the Hon'ble Courts, and directions are issued for strict adherence by Chief Educational Officers, District Educational Officers and all Head of Departments: Immediate action shall be taken on the orders issued by the Hon'ble High Court. The stipulated timelines for compliance are not to be taken lightly, and we must prioritize prompt execution of the court's directions. As soon as judgements are received, the same has to be uploaded in a legal management system and processed and monitored deligently.

Upon receiving a copy of the Court Order, it is mandatory to seek legal opinion from the appropriate Law Officer of the Government regarding the further course of action. If the decision taken is not to file an appeal swift steps must be taken to implement the order within the specified time frame

In cases where it is determined that an appeal is the appropriate course of action, the appeal must be filed in the relevant court, and every effort should be made to obtain a stay, if deemed necessary.

Action Taken Report on judgements delivered by the Hon'ble Court and the Supreme Court of India must be personally monitored periodically through Legal Management System at all levels across state (ie from BEOS DEOS CEOS, JDS and Heads of Departments) Each Directors/SPD/Chairman shall ensure strict compliance with court orders to prevent any breach or contempt of the court's directives.

2) All HODs are directed to conduct detailed weekly reviews of court cases pending in all your subordinate offices and your own offices and take necessary action If any advice or guidance needs to be sought from senior officers, the same sbould not be restrictd to just write, communication, but in-person meetings can be conducted to expedite matters as court cases are strictly time-bound

3. Any lapses or oversight by any officers regardless of the level should be dealt with very strictly and seriously.
