PROCEEDINGS:

In the Proceedings first read above, orders were issued introducing the Tamil Nadu Electricity Board Pensioners' Family Security Fund Scheme to the pensioners who retired after 01.04.1997, based on the orders issued by the Government vide G.O.Ms.No.762, Finance (Pension) Department dated 31.12.1996. Among others, It was ordered therein that in case of death of a pensioner after making the contribution for one year, a lumpsum amount would be paid to the spouse. If the spouse is not alive, the amount would be paid to the nominee. If no nomination is filed, the amount would be paid to all the legal heirs in equal shares. 2. Based on the instructions issued by the Government in letter No.6461/ Pension/97-2, Finance (Pension) dated 28.10.1997, orders were issued in the Memo. second read above, instructing the pensioners not to file any nomination in favour of his/her spouse under the Tamil Nadu Electricity Board Pensioners' Family Security Fund Scheme, if the spouse is alive and if the spouse predeceases him/her, the pensioner should file nomination in favour of his/her family members only

Subsequently, based on the Instructions issued by the Government, in letter No.47652/PGC/98-1, Finance (PGC) Department, dated 13.11.1998, further Instructions were issued in the Memo. third read above that in cases where the spouse is living, the amount should be paid only to the spouse. No nomination should be filed by the pensioner in cases where the spouse is living. 4. Lateron, by adopting the orders issued by the Government, in G.O.Ms.No.416, Finance (Pension) Department, dated 18.11.2010 orders were issued in the Proceedings fourth read above, that a subscription of one month may alone be enough for sanction of FSFS amount under the Tamil Nadu Electricity Board

Pensioners Family Security Fund Scheme to the familles of the deceased pensioners.

5. Now, the Government in its letter fifth read above, have issued orders permitting the Pensioners to file nomination under Tamil Nadu Pensioners Family Security Fund Scheme even when both the Pensioner and his/her spouse are alive in order to avoid any contingency at the time of claim and to streamline the procedure in the best interests of the Pensioners. Further, in Government's letter sixth read above, instructions have been issued that such nomination applications shall be sent through proper channel. 5. As the instructions issued by the Government in this regard from time to time have been adopted in TANGEDCO, necessary proposal has been placed before the Board of TANGEDCO for adoption of the instructions issued in Government letters fifth and sixth read above for its approval. In its Board Meeting held on 08.02.2023, the Board has resolved to adopt the instructions issued by the Government. Accordingly, it is hereby ordered that the Pensioners of TANGEDCO be permitted to file nomination under Tamil Nadu Electricity Board Pensioners' Family Security Fund Scheme even when both the Pensioner and his/her spouse are alive, in order to avoid any contingency at the time of claim and to streamline the procedure in the best Interests of the Pensioners. The pensioners are instructed to send such nomination applications through proper channel.

6. The Pension Sanctioning Authorities are instructed to collect the nomination forms from the pensioners and to send them to the Chief Internal Audit Officer/Audit Branch so as to enable him to sanction the FSFS amount under the Tamil Nadu Electricity Board Pensioners' Family Security Fund Scheme to the familles of the deceased pensioners at the time of claim. 8. Having regard to the above Instructions, all Pensioners are entitled to file nomination afresh if required, in the light of the instructions in paragraph 6 above.
