TRB - PG மேல்முறையீட்டு வழக்கு விவரம் :

2017 ஆம் ஆண்டு TRB நடத்திய முதுகலை ஆசிரியர் தேர்வில் வேதியியல் பாடத்தில் மீண்டும் சான்றிதழ் சரிபார்ப்பு.

2017 ஆம் ஆண்டு TRB நடத்திய தேர்வில் வேதியியல் பாடத்தில் தவறாக கேட்கப்பட்ட ஆறு கேள்விகளுக்கு நீதிமன்றம் மதிப்பெண் வழங்க உத்தரவிட்டது.

ஆனால் ஆசிரியர் தேர்வு வாரிய கமிட்டி மேல் முறையீடு செய்த வழக்கில் (WA(MD).194 to 199 of 2019 to 212 of 2018 on 16.02.2018)வழக்கு தொடுத்தவருக்கு மட்டுமே அது பொருந்தும் என்று தீர்ப்பு கொடுக்கப்பட்டது . இத்தீர்ப்பை எதிர்த்து வேதியியல் தேர்வர் சீராய்வு வழக்கு தொடுத்தார் அத்தீர்ப்பில் வழக்கு தொடுக்காதவருக்கும் பொருந்தும் என்று தீர்ப்பு அளிக்கப்பட்டது.

இத்தீர்ப்பினை எதிர்த்து TRB மீண்டும் சுப்ரீம் கோர்ட் சென்றது(SLP.26469 of 2020 on 29.04.2022) அத்தீர்ப்பிலும் re -do the entire process என்று தீர்ப்பு கொடுக்கப்பட்டது . இதனைத் தொடர்ந்து வேதியியல் தேர்வர் தொடர்ந்த மேல்முறையீட்டு வழக்கில் (WA.2554 of 2022 on 15.07.2024) ஆஜரான ஆசிரியர் தேர்வு வாரிய கமிட்டி இன்று வரை selection process முடியவில்லை என்று கூறியுள்ளது.

மேலும் ஆசிரியர் தேர்வு வாரியம் selection process முடிக்க நான்கு மாத காலம் அவகாசம் வழங்கி வழக்கை முடித்து வைத்தனர்.

JUDGMENT

(Judgment of the Court was delivered by D.KRISHNAKUMAR, J.) The appellant/writ petitioner has filed the writ petition seeking award of marks for the question wrongly framed and for a direction to the Teachers Recruitment Board to call the appellant/petitioner for certificate verification for the post of P.G.Assistant. 2. The writ court, by order dated 09.09.2022, had dismissed the writ petition on the ground that the issue had already been decided by the Hon'ble Division Bench of this Court in W.A.(MD) No.194 to 199 & 2019 to 212 of 2018 on 16.02.2018. Consequently, respondents/Teachers Recruitment Board undertook the process of verifying the answer sheets of the candidates and accordingly, selected all the eligible candidates and appointment orders were also issued. Since the appellant/petitioner had scored only 73 marks less than the qualifying marks, he was not within the zone of consideration in BC category and therefore was not called for certificate verification. Challenging the said order, the appellant/petitioner has filed the present intra court appeal.

Learned Special Government Pleader appearing for the respondents 3 and 4 submitted that against the order passed in W.A.(MD) No.194 to 199 & 2019 to 212 of 2018 dated 16.02.2018, the Education Department has preferred an appeal before the Hon'ble Supreme Court in SLP No.26469 of 2020. The Hon'ble Supreme Court by order dated 29.04.2022 has held as follows:
